A Nominee Is Not the Same as a Legal Heir
This is one of the most misunderstood concepts in estate planning, and it's important to understand clearly:
Nominee
A person you designate to receive or manage an asset (like a bank account or insurance policy), but under Indian law, a nominee is generally considered a trustee or custodian of the asset, not necessarily its final legal owner.
Legal Heir
Determined by a valid will, or by succession law if there is no will, determining who the asset legally belongs to.
Potential Conflict
If a nominee and the legal heirs are different people, disputes can arise, and the nominee may be legally required to hand over the asset to the rightful legal heirs.

The DPDP Act's "Right to Nominate"
India's Digital Personal Data Protection (DPDP) Act 2023 introduced a notable new provision: individuals (referred to as "Data Principals") can now nominate another person to exercise their data rights in the event of death or incapacity.
